SMS Opt-In Policy
This SMS Opt-In Policy describes how Fennec Solutions and our business clients handle SMS consent, messaging, and opt-out rights. We take messaging compliance seriously and are committed to full compliance with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and carrier messaging policies.
1. Who Sends These Messages
Fennec Solutions powers AI sales agents for businesses across multiple industries — including automotive dealerships, solar companies, real estate agencies, law firms, and HVAC companies. When you receive an SMS through a Fennec-powered agent, the message is sent on behalf of the specific business you engaged with, not Fennec Solutions directly.
The message will identify the business sending it (e.g., "Hi, this is Alex with Summit Auto Group"). The sending business is responsible for obtaining your consent before initiating contact.
2. How Consent Is Obtained
Fennec Solutions and its business clients obtain your consent to receive SMS messages through the following methods:
- Web form opt-in: You submit your name, phone number, and inquiry on a website contact form. Before submission, the form displays the required SMS consent disclosure and an unchecked checkbox that you must actively check to proceed. The disclosure reads: "I agree to receive automated SMS messages from Fennec Solutions regarding my inquiry and demo scheduling. Message frequency varies. Message & data rates may apply. Reply STOP to unsubscribe at any time. Reply HELP for help." Links to our Privacy Policy, Terms of Service, and SMS Policy are visible on the same screen.
Required disclosure at point of consent:
"By submitting your information, you agree to receive automated text messages from [Fennec Solutions] about your inquiry. Message and data rates may apply. Message frequency varies. Reply STOP to unsubscribe at any time. Reply HELP for help."
3. Message Types
SMS messages sent through Fennec-powered agents may include:
- Initial responses to inquiries you submitted
- Follow-up questions related to your stated interest (vehicle, property, service appointment, etc.)
- Appointment confirmations and reminders
- Responses to your inbound messages
We do not send promotional bulk SMS blasts. All messages are triggered by your inquiry or response and are directly related to the service you requested information about.
4. How to Stop Messages
You can opt out of SMS messages at any time by replying with any of the following keywords:
STOP CANCEL QUIT END UNSUBSCRIBE
Upon receiving any of these keywords, you will receive one final confirmation message and no further messages will be sent. Your opt-out is permanent and honored immediately. Opting out of one business's messages does not opt you out of other businesses' messages.
5. How to Get Help
Reply HELP to any message to receive information about the sender and how to contact them. You can also contact the business directly using the information they provided, or reach Fennec Solutions at hello@fennecsolutions.ai.
6. Message and Data Rates
Standard message and data rates from your mobile carrier may apply to messages you send and receive. Fennec Solutions and its clients do not charge additional fees for SMS communications. Contact your mobile carrier for details on your messaging plan.
7. Message Frequency
Message frequency varies based on your inquiry and responses. Most conversations involve 4–12 messages total. You will not receive recurring promotional messages. If you do not respond to messages, follow-up attempts are limited.
8. Supported Carriers
SMS messaging is supported by all major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and regional carriers. Service may not be available on all carriers or in all areas.
9. Privacy of Your Information
Your mobile number and conversation data are processed in accordance with our Privacy Policy. We do not sell your phone number to third parties. Your number is only shared with the specific business whose agent you were communicating with.
10. Compliance
Fennec Solutions is committed to compliance with:
- Telephone Consumer Protection Act (TCPA)
- CAN-SPAM Act
- CTIA Messaging Principles and Best Practices
- Twilio Acceptable Use Policy
- All applicable state and federal consumer protection laws
Fennec maintains a global suppression list. Once a number opts out, it is suppressed across our platform and will not be contacted again by the same business.
